Subject: Censure of Director Burkel and Ms. Burkel


Dear Master Board Members and General Manager;

It has come to the attention of Sun Lakers for Accountability that several members of our community, who signed the petition to recall Director Burkel, were contacted by Nora Burkel with the intent of harassing them for their decision to sign the petition. The list of members coming forward continues to grow.

Needless to say, this action is quite negative for our community on several levels:

  1. Did Mr. Burkel provide Ms. Burkel access to the petition? If not, how did she come in possession of it?

  2. Ms. Burkel use of confidential information, restricted to the Board, to possibly influence the outcome of the pending recall election.

  3. Mr. Burkel's inability to prevent such action - Can he be trusted?

  4. Mr. Burkel should be aware that representing himself as a CPA holds him to a higher standard than is often the case under the "business judgement rule" when it comes to confidentiality and due diligence.

I believe this also warrants a deeper investigation into what other confidential board information he has shared with Ms. Burkel and perhaps others. Dating back to at least a years ago, Ms. Burkel has been posting information on Facebook indicating that Troon would be selected to replace FSR, as if it were a fact, and attempting to use her inside understanding of confidential board information to defend other of Mr. Burkel's decisions.

This is not a trivial matter. It must cease and desist. The brazen nature of this brings into question the extent to which Mr. and Ms. Burkel have used or chosen to share confidential information in the past.

We suggest that the Board consult with our HOA legal counsel to advise the entire board on the seriousness of such a major indiscretion.

There is also the matter of equal treatment of members. If board members selectively choose to abandon executive session confidentiality with some members, then they must share that information with all!
